Mayor Cy Responds to Allegations

Mayor Cy, in his personal Blog, is refuting the accusations against him, as well as the reasons for the recall election.

He answers the allegations given, which became the reasons to validate a recall election. Specifically they are: 1) illegally using the Pacific Police Dept. for personal use, and 2) not complying with the court order to fill vacant positions.

Mayor Cy's direction to the Pacific Police Department had to do with investigating whether the Police Department used city resources to investigate his personal business and affairs in Oregon. He had information leading him to believe the Police Department had used Pacific resources to investigate his property in Oregon, and if so, it was an improper and illegal use of the city's resources. If the Police Department was conducting this type of investigation, it was totally outside their jurisdiction. He has valid reasons to consider that he was "set up" when he was asked to sign a Police Investigation memo, originated by the Police Department. Mayor Cy is not a police officer, nor an attorney, and these kinds of documents can easily be constructed to later embarrass him, which he now believes happened. Not surprising to many!
 
Also, His attempts to request explanations of why officers had travelled outside their jurisdiction, when not directed to do so, are valid reasons to conduct an investigation.

As for not filling city positions, Mayor Cy continues to contend that the City Council blocked his attempts to fill positions with qualified people.

Mayor Cy was elected on his promise that he would fight against what he, and many citizens, saw as an entrenched corruption in the City of Pacific. His attempts to request explanations of why officers had travelled outside their jurisdiction, when not directed to do so, are valid reasons to conduct an investigation.
 
Though he has been thwarted in his attempt to fill vacant positions, he was still able to obtain insurance coverage for the city, and there was no lapse in liability coverage.

Mayor Cy's Blog ... Exposing Corruption

Mayor Cy has been posting to his personal blog for several months. You need to take time to go there and investigate what he has been revealing...it is rather shocking! Mayor Cy's personal blog explains some of the extreme financial burdens some employees have cost the city. He gives detailed expenses from payroll vouchers, council minutes, and activities of the City Council. Mayor Cy calls his writing, "My Turn." That is very appropriate.

As you scroll down the page you go from the newest to the older posts. He explains the extreme legal costs over the past year (re: King 5 article, "Legal Expenses Skyrocket").

Also, this shows how Mayor Cy reduced the payroll by $239,000 by using consultants for the cost of $32,000 (instead of paying $580,000 in employee salaries). Consider the cost savings these consultants made in obtaining grants, increasing revenue, and saving projects that would have cost the city hundreds of thousands of dollars had they been canceled.

Smut Politics

Can you believe this? Mayor Cy was given a copy of a web site that has been attributed to him and his wife. The website was created or edited with information and captions written to be published, possibly during the "Heat" of RECALL voting to discredit his true identity which is simply "Cy Sun." Neither he, nor his wife, have ever created, nor had, any website.

If you go to the website shown on Mayor Cy's blog you will see that the dates are totally phony! Amazing the extent some will go to smear someone. Why can't we just look at facts, then make our judgments from there?

Illegal Meeting


“Motion to Reconsider” by City Attorney Luce – Evidently even Luce states that the Civil Service Commission held an illegal meeting that was in violation of the Open Public Meeting Act. This document is asking for a rescinding of that action.

Detective Newton

Do the citizens of Pacific feel the same way as the City Attorney, Officer Calkins, or the City Council?” After they discussed Detective Newton’s behavior and actions in Executive Session last week, they put him back to work. No disciplinary action was taken, period. Here are documents explaining what this is all about…read it and you decide if the city did the right thing, or was Mayor Cy correct in putting him on paid administrative leave while he had this situation investigated.

1. “Letter received” – A letter received April 9, 2013, concerning alleged misbehavior of Officer Newton. This is a letter sent to Mayor Sun and Chief Calkins or the acting Police Chief. It is requesting a thorough investigation of Detective Newton and his actions.”

Civil Service

The attached motion was filed in court in response to the Pacific's Civil Service Commission's action. The judge came to court with his motion already prepared but allowed the Civil Service Commission to argue their case.

Never mind that, as you consider the following:
  • “Administrative leave” does not equate to "suspension"; notice that case law supports this, all the way up to the US Supreme Court.
  • The Civil Service Commission conducted an illegal meeting, and the hearing was a violation to the Open Public Meeting Act.
  • The Civil Service Commission came to their meeting with their motion already typed, violating Civil Service Rules; they are not supposed to discuss anything outside of the meetings.
  • Civil Service does not have the authority they exerted, they are merely an advisory board.
The Court ordered the following:

  1. Rescind the unlawful order reinstating Public Safety Director Calkins and Lt. Massey entered by Mayor Pro Tem and Council Member McMahan on April 8, 2013
  2. Approve and confirm the appointment of Mayor Sun’s selection for interim city clerk, based upon his legally supported tie-breaking vote on March 25, 2013
  3. Approve and confirm an independent investigator, paid for by the City of Pacific, for investigation of personnel whistleblower complaints
  4. Approve and confirm the appointment of the services of a qualified, stand-in City Attorney who is to be paid by the City of Pacific, for purposes of advising the Mayor and pursing available remedies on the Civil Service Commission ruling and the precedent it has wrought upon the City

Ordered to Return Cops to Duty

Despite the investigation into corruption in the police department, King county Superior Court Judge Patrick Oishi ordered Pacific Mayor Cy Sun to return two suspended police officers to duty on Friday, May 10.

According to the Auburn Reporter, “Massey and Calkins were placed on paid administrative leave by Sun on March 22, pending the outcome of an investigation into claims of intimidation and harassment with another city employee.”

 “At the hearing on Friday, Sun's attorney Tyler Firkins, argued that the officers were not suspended for disciplinary reasons, merely placed on leave for their safety and the safety of the other city employee being investigated in the harassment and intimidation matter.”
